“Ben O’Sullivan represented me in my AVO matter, Divorce and Financial Separation. Ben’s experience, dedication, professionalism and knowledge and understanding of all facets of law was paramount to me receiving desired outcomes on all of my very complex issues.

At all times, I was kept informed of the process. Ben went beyond his call of duty as a lawyer, he also became a much needed support, and I relied upon him for psychological support.

He was always there for me around the clock, no call ever went unanswered and actioned. Ben, thank you again for coming on board when you did.”

Family Lawyer Melbourne FAQs

Can I get legal aid for family court in Victoria?

Yes, it is possible to get legal aid to help you pay for family court in Victoria. However, the support is only available in limited circumstances. This is because the court encourages parties to resolve their matter via other means, like dispute resolution, before attempting to litigate.

Victoria Legal Aid has more information on accessing Victoria Legal Aid and Family Dispute Resolution.

What documents do I need to apply for divorce in Victoria?

The documents you will require will depend on your circumstances:

Application for Divorce form: This is the primary document required to initiate the divorce process. You can complete the form online through the Commonwealth Courts Portal or download it from the Federal Circuit Court of Australia website.

Marriage Certificate: A copy of your official marriage certificate is necessary to establish the validity of your marriage. If your marriage certificate is not in English, you will also need to provide a certified translation.

Proof of Australian Citizenship or Residency: If you or your spouse are not Australian citizens, you will need to provide proof of residency (such as a permanent resident visa) to show that you or your spouse have been living in Australia for at least 12 months before filing for divorce.

Supporting documents: Depending on your circumstances, you may need to provide additional documents that pertain to your case, such as affidavits, consent orders, or parenting plans if you have children.

Service documents: If you are filing a sole application, you will need to serve the divorce application on your spouse and provide proof of service. This may involve completing an Affidavit of Service form and, in some cases, a separate Acknowledgment of Service form.

If you require assistance in applying for a divorce or navigating the process, get in touch with our team.

How much child support will I need to pay?

The Services Australia Calculator can give an estimate of what you might need to pay in child support, but this is not an exact science. Various factors influence what you may be required to pay.

If I haven't done anything wrong, why do I need a family lawyer?

Family law matters are not about assigning blame – in fact, Australia has a policy of ‘no-fault divorce’, meaning that the court process is not interested in issues like infidelity or other catalysts for a separation. Hiring a lawyer isn’t about determining who is to blame; it is about ensuring you have the legal expertise on your side to secure the best possible outcome in contrast to your spouses’ demands.

Can O'Sullivan help me overturn a decision made in family court?

Yes, this is possible. When a decision is made in family court, there is a timeframe where we can step in and apply for an appeal. If you have received an unfavourable decision, speak to us today to see how we can help.

We make the family law process simple and stress-free. Talk to us today.
